Appeal refused

Leave to appeal an interlocutory injunction against its advertising has been denied to Robin Hood Multifoods of Toronto.

Robin Hood was seeking to appeal the injunction against advertising for its frozen pie crust products as ruled on Sept. 29 by Mr. Justice Peter Jarvis of the General Division of the Ontario Court.

Mr. Justice John G.M. White did not give specific reasons for dismissing the motion to appeal the injunction heard on Nov. 14.

The injunction was the result of an action brought by competitor Toronto-based Maple Leaf Foods, maker of Gainsborough and Tenderflake brand frozen pie crust.

Justice Jarvis ordered that Robin Hood’s magazine ads be pulled because they were false and misleading and Maple Leaf’s brands would suffer irreparable harm if they were not banned.

There is no mention of competitors.
